Academic endeavors
Thought this might be a fun idea for a thread.
I've finally got around to registering for my Master thesis, which I'll be writing this spring. I've been postponing it for a little while as I didn't really feel ready, but it was getting to be about time I think. Still not sure I feel a 100% ready, and it'll be odd to be done and not being a student anymore, but hopefully it'll be fun.

It's not all that advanced, really. You know when you have copyright for something, right? Well, copyright is kind of a limitation, in the EU context, on the normal freedom of movement of goods and services. So, it can only be allowed to hamper this as long as the concerns behind it are sufficiently heavy in relation to the concerns for free movement of goods and services. There are therefore limitations to copyright. A rights holder does have the copy right to his work, but when he sells it, the first sale doctrine, some of those rights are exhausted, the exhaustion principles. For instance the buyer now have the right to sell his copy of the copyrighted work on.
In the EU you have copyright for computer programs after the Software-directive. In the Usedsoft-case the page usedsoft.com or whatever were allowing people to sell on their used licensed versions of computer programs. They were sued by Oracle who claimed giving someone access to a computer program for a license didn't constitute a sale and therefore don't lead to exhaustion of their rights in the programs. The EU.court responded that making a computer program available by license, for an unlimited amount of time, for a price that constituted the value of the program constituted a sale in the context of the Software-directive.
In the US in a corresponding case and american court came to the opposite result. I was kind of planning to look at whether the particular circumstances of the EU, where concerns for free trade stands very strongly, played a role in these results differing..
